Official Rules (“Official Rules”)

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.

By entering into this Sweepstake, I accept the terms and conditions and set forth in these Official Rules. I confirm I am at least 21 years old and have reached the age of majority in my jurisdiction of residence at the time of opt-in. No purchase is necessary. A purchase will not increase my chances of winning. I agree to sign up to receive newsletters and special offers from Kiwi Collection knowing that I can unsubscribe at any time and that my subscription status will not affect my chances of winning.

Eligibility: The Luxury Travel Lover's Giveaway (the “Sweepstake”) is open to legal residents of countries where laws do not prohibit individuals from entering such sweepstakes (excluding residents from Quebec, Alaska, Hawaii, Rhode Island, overseas military installations, Puerto Rico, and other U.S. Territories) who have reached the age of 21 at the date of entry. Individuals from countries where laws prohibit individuals from entering such sweepstakes cannot participate. Entry in this Sweepstake constitutes acceptance of and agreement to these sweepstake rules (the “Sweepstake Rules”). These Sweepstake Rules exempt Kiwi Collection Inc. and other persons from liability and contain other important provisions. If you do not agree with each and every provision of these rules, you may not participate in the Sweepstake.

Directors, officers, or employees of the Sponsor, its affiliates, subsidiaries, related companies, advertising and promotional agencies, and the household members and/or the immediate family of any of the above are not eligible to participate in the Sweepstake. For the purpose of these Sweepstake Rules, “immediate family” means spouse, mother, father, brother, sister, son and daughter, whether or not they reside in the same household.

The Sponsor shall have the right at any time to require proof of identity and eligibility to participate in the Sweepstake. Failure to promptly provide such proof may result in disqualification. All personal and other information requested by and supplied to Sponsor for the purpose of this Sweepstake must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right in their sole discretion, to disqualify any entrant, should an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal and other information.

Sponsor: The Sweepstake is sponsored by Kiwi Collection at 200 Granville Street, Suite 1030, Vancouver, B.C., V6C 1S4.

Agreement to Official Rules: By entering the Sweepstake, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Entry Period: The Sweepstake begins at 7:00am PST on 5/21/2024 (“Entry Period”). The Sweepstake will end on 5/30/2024 at 11:59pm PST. Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official timekeeping device for the Sweepstake.

How to Enter: At the beginning of the Entry Period, you may enter the Sweepstake by visiting the sweepstake site https://www.kiwicollection.com/inspiration/luxury-travel-lovers-giveaway (the “Sweepstake Site”) and completing the Sweepstake entry form. There is a limit of one (1) entry per person/email address. Additional entries per person/email address will not be acknowledged. The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion.

Drawing: After the Entry Period, on or about 5/31/2024, Sponsor will select 1 potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received.

The random draw will be made within forty-eight (48) hours from the close of the Sweepstake. Within twenty-four (24) hours of the random draw, the selected entrant will be notified by email at the email address provided. To win the prize, the selected entrant must: (1) comply with the Sweepstake Rules; and (2) upon notification, correctly answer, unaided by any other person, a time-limited, mathematical, skill-testing question administered by the Sponsor. In the event that the selected entrant is unable to answer the question, cannot be reached within forty-eight (48) hours of the notification date, or otherwise does not meet all Sweepstake conditions, their prize will be forfeited and the Sponsor will award the prize (subject to these Sweepstake Rules) to another selected entrant drawn at random from the remaining eligible entries.

Notification and Requirements of Potential Winners: Sponsor will attempt to notify potential winner within one (1) business day of the drawing by email. If a potential winner does not respond within two (2) calendar days after the notice is sent, the Sponsor will select an alternate potential winner in their place at random from all remaining entries received. Alternate potential winners will continue to be contacted until a winner responds. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in their place in a random drawing of all remaining entries received.

Prize(s): One (1) grand prize will be awarded and one (1) winner will be chosen. The winner must redeem their hotel credit between July 1, 2024 and June 30, 2025. The prize package will be shipped to the winner's residence at Kiwi Collection's expense.

*Kiwi Collection Hotel Credit Terms:

Winner must book through Kiwi Collection’s Reservations Team by phone or email
Reservations are subject to hotel availability at time of booking
Must book by 5/31/25 and stay by 6/30/25
All bookings must be completed at least 30 days prior to check-in date
Credit is for accommodation cost only (room + tax) and must be used in one hotel stay—any remaining credit upon check-out will be lost and cannot be redeemed for cash
The prize winner is solely responsible for any purchase amounts, in full or in part, that exceed the given travel credit
All travel expenses are the sole and exclusive responsibility of the prize winner
Credit cannot be applied to non-refundable and/or pre-paid rates
Credit is non-transferable, cannot be redeemed for cash and cannot be used in conjunction with any other promotional packages
Cancellation terms apply and will be communicated at time of booking
If the reservation is canceled within 7 days of arrival or within the hotel’s cancellation policy, the credit will be forfeited and cannot be reused

General Conditions: In the event that the operation, security, or administration of the Sweepstake is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstake to address the impairment and then resume the Sweepstake in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstake or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstake may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

Release and Limitations of Liability: By participating in the Sweepstake, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, the prize providers and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstake or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstake; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstake or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstake or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstake, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Privacy and Use of Information Submitted; Publicity: Any information you submit as part of the Sweepstake will be used for purposes of this Sweepstake and treated in accordance with Sponsor’s Privacy Policy as otherwise set forth in these Official Rules. Except where prohibited, participation in the Sweepstake constitutes an entrant’s consent to Sponsor’s use of their name, likeness, voice, opinions, biographical information, and province or state of residence for promotional purposes in any media without further payment or consideration.

Use of Entrant Information: For those that chose to opt-in to the newsletter via the Sweepstake entry form, you acknowledge and agree that Kiwi Collection will use Entrant’s information including your email address or any other contact information provided for general solicitation, marketing, or other business or promotional activities in connection with the services and products they provide. You may at any time revoke the use of such information by using the unsubscribe link provided in the email. Please note that your opt-out preference will apply to marketing communication and may not apply to transactional communication including those associated with your entry.

Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstake or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Vancouver, B.C. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstake, shall be governed by, and construed in accordance with, the laws of B.C., without giving effect to any choice of law or conflict of law rules (whether of B.C. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than B.C.

Third Party Platforms: If this Sweepstake is hosted, administered, or operated on a third party platform, including without limitation a social media platform (e.g. Facebook or Instagram or Pinterest) (“Third Party Platform”), then by participating in this Sweepstake, entrants hereby release and agree to comply with all rules and policies set forth by such Third Party Platform and to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Official Rules, this Sweepstake is not sponsored, endorsed or administered by, or associated with, any Third Party Platform.
